Representation Terms & Conditions

Assistance in relation to any matter arising from a BAPN member’s employment, is granted in accordance with these terms and conditions.

Assistance is provided by trained, experienced caseworkers

BAPN caseworkers offer a variety of help, support and advice to our members. However, we are not trained counsellors, and, in some circumstances, it might be more appropriate for you to consider contacting specialist counselling services.  BAPN will talk you through this if we consider it more appropriate for you under the particular circumstances.

Our caseworkers are not solicitors.  Should your issue require specialist legal advice, a claim in the employment tribunal for example, we can refer you to our partnered solicitors who will advise you.  This service attracts a considerable discount to you through your BAPN membership.

Casework assistance cannot be provided:

  • with regards to issues which pre-date membership; or

  • to members who are in arrears with their subscriptions at the time the issue arose.  Unfortunately entitlement to representation cannot be re-established by paying off arrears.

  • BAPN does not provide dual representation.

If you have or intend to instruct or seeks advice from your own legal adviser or an alternative representative or any other third party in connection with your case, BAPN will withdraw from further involvement and you will be responsible for any costs incurred.

BAPN cannot offer person representation to overseas members.  This is mainly due to country legislation variations.  

Casework assistance is provided at the discretion of BAPN’s Managing Directors who retains the right to withdraw casework assistance at any time should it become apparent that the member is in breach of these terms and conditions.  All such eventualities will be given in writing to the member.

Members seeking assistance must provide us with all the information in relation to the case and be prepared to co-operate fully in the investigation, preparation of the case. Members are expected to be honest and accurate in the information they give us. Should it become apparent that necessary information is being withheld or that the issue pre-dates membership then casework support will be withdrawn.
